The logos for my two companies in the past were both trademarked. On a side note, if you want to scale up a logo make sure that it's a vector based graphic and not a raster based graphic. Vector based graphics can be scaled to infinity without losing any resolution. Programs like Corel Draw or the free Inkscape are the tools to do this work. Without addressing the trademark & copyright issues, it's pretty easy to trace a bitmap image with something like Corel Draw or Inkscape to turn it into a vector image.
I once worked for a company that did private-brand labeling and we'd have to reproduce the customer's logo/typography exactly, not only for labels but for catalogs, banners and other marketing materials. The customer could be counted on to only give us a bitmap or (more commonly at the time we were doing this) just a printed image.
I was never particularly adept at Corel or Inkscape, but I could get these images duplicated without any noticeable difference from the original and we could scale it for whatever purpose was required.
